Floxity Terms of Service

Welcome to Floxity! These Terms of Service ("Terms") govern your access to and use of the Floxity platform, operated by Sebastian Maronn Digital Experiences (sole proprietorship of Sebastian Maronn) ("Floxity", "we", "our", or "us"). By accessing or using our platform, you agree to be bound by these Terms.

1. Overview of the Platform

Floxity is a survey platform that allows users to create, manage, and analyze surveys with customers, colleagues, and friends. Access is available via a freemium model with optional prepaid usage-based pricing.

2. Eligibility

You must be at least 18 years old and have full legal capacity to form a binding contract in your jurisdiction.

If you are between 16 and 18 years old, you may use Floxity only with the assume full responsibility for all use of the Service.

3. User Accounts and Roles

  • Users must register to use Floxity's core features and may be assigned one of the following roles within an account: Admin, Editor, or Viewer.
  • You are responsible for safeguarding your account credentials and all activity under your account.

4. Acceptable Use

You agree not to use Floxity to:

  • Post or distribute content that is unlawful, harmful, abusive, discriminatory, threatening, or harassing.
  • Submit false or misleading information.
  • Attempt to interfere with the integrity, performance, or security of the platform.
  • Engage in unauthorized scraping or data extraction.

We reserve the right to suspend or terminate accounts involved in abusive behavior or policy violations.

5. Pricing and Payments

  • Floxity offers a free tier and optional prepaid usage packages. Details are available at https://floxity.com/pricing.
  • Users may enable optional auto-renewal. This is disabled by default.
  • Credits are irrevocably credited to your account immediately after successful payment.
  • Because credits are digital content available instantly, no statutory right of withdrawal applies once you have expressly consented to immediate delivery during checkout.
  • Refunds are only possible in the event of proven technical errors on our side that prevent the credits from being usable.
  • We reserve the right to recover any fees and pursue legal action for illegitimate chargebacks or payment reversals.
  • Payments are processed via Stripe, and Floxity does not store your payment information directly.

6. Survey Data and Ownership

  • You retain ownership of the survey data you collect.
  • You may export your data via CSV or API at any time.
  • We store your data securely to provide the service; we do not use your data for training AI models or marketing purposes, nor do we sell it to third parties.
  • When using AI-assisted features to generate survey content, the output is generated via the OpenAI API. You retain rights to this AI-generated content, but are responsible for reviewing it for accuracy, relevance, and compliance with applicable laws. Per OpenAI’s policy, data sent through their API is not used to train or improve their models.

7. Service Availability

  • Floxity strives to maintain reliable uptime and may schedule maintenance with prior notice.
  • We perform regular backups, but cannot guarantee against data loss.
  • You agree that Floxity is not liable for temporary service interruptions, data loss, or access issues beyond our control.

8. Disclaimers

Insights derived from surveys are based on user input and system algorithms and may not reflect objective truth. Use them at your discretion.

Floxity is provided "as is" without warranties of any kind, including fitness for a particular purpose or non-infringement.

9. Termination

  • You may delete your account at any time. All associated data will be permanently deleted and cannot be recovered.
  • Deleting your account does not entitle you to a refund for any unused credits or prepaid amounts.
  • We reserve the right to suspend or terminate your account if you violate these Terms or misuse the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Floxity and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to access the platform; (b) any conduct or content of any third party on the platform; (c) any content obtained from the platform; and (d) unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Floxity and its owners from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the platform; (b) your user content; or (c) your violation of these Terms.

12. Intellectual Property

All intellectual property rights in the platform, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by Floxity or its licensors. Except as expressly provided in these Terms, you are granted no right, title, or interest in the platform or its content. You may not copy, reproduce, modify, distribute, or create derivative works of any part of the platform without prior written consent.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Germany. For business users, the exclusive place of jurisdiction is Berlin, Germany. For consumers, the mandatory statutory provisions of the country of your habitual residence remain unaffected.

14. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect.

15. Changes to the Terms

We may update these Terms occasionally. If changes are material, we will notify you via email or an in-app notification. Continued use of Floxity after the effective date of the revised Terms constitutes acceptance of the changes.
